These terms and conditions of sale are concluded on the one hand by LE CERISIER EN VILLE, a public limited company (SA) whose registered office is located at 14 Avenue du Peuple Belge, 59000 Lille, registered with the Lille Trade and Companies Register, hereinafter referred to as “lecerisier.com”, and on the other hand, by any natural or legal person wishing to make a purchase via the website lecerisier.com, hereinafter referred to as “the buyer”.

Article 1: Purpose

These terms and conditions aim to define the contractual relationship between lecerisier.com and the buyer, as well as the applicable conditions for any remote and electronic purchase made through the online store lecerisier.com, whether the buyer is a professional or a consumer.

Purchasing a product or service through this website implies full and unconditional acceptance by the buyer of these terms and conditions of sale.

These conditions shall prevail over any other general or specific terms not expressly approved by lecerisier.com.

lecerisier.com reserves the right to modify its terms and conditions at any time. In such cases, the applicable terms will be those in force on the date of the order by the buyer.

Article 2: Characteristics of Goods and Services Offered

The products and services offered are those listed in the online store published on the website lecerisier.com.

lecerisier.com reserves the right to modify the presentation of deliverable dishes.

Depending on seasonal availability, some of our dishes may vary.

Article 3: Click & Collect

The buyer cannot modify the time slot reserved on lecerisier.com once the order has been placed.
lecerisier.com reserves the right to cancel or change the chosen time slot depending on the restaurant’s capacity, and will notify the customer accordingly.

In the event of a delay of more than 15 minutes beyond the agreed Click & Collect time, the buyer will forfeit their order and will not be entitled to any refund.

Article 4: Product Illustrations

The seller is responsible for providing the customer with essential information about the products.

The photographs displayed on lecerisier.com are as accurate as possible but cannot guarantee perfect resemblance to the actual product delivered. It is noted that computer screens may display colors differently.

No claims will be accepted regarding differences in presentation of our dishes.

Article 5: Allergies, Food Intolerance, or Special Diets

As our products are food items, customers must take all necessary precautions regarding allergies, intolerances, or dietary restrictions, or inform us in advance before placing an order.

Article 6: Prices

The prices shown in the catalog are inclusive of all taxes (VAT included) in euros, based on the rate applicable on the day of the order. Any change in VAT rate may be reflected in product or service prices.

lecerisier.com reserves the right to modify prices at any time, but the price applied will be that shown on the website at the time of the order.

The indicated prices include order processing fees.

Article 8: Orders

The language offered for contract conclusion is French. The contract is concluded, under the provisions of the Civil Code, upon the second confirmation click, through which the buyer validates their basket after reviewing and correcting it.

To purchase a product or service, the buyer must:

  • Complete the identification form with the required contact details or provide their customer number if applicable;
  • Complete the online order form with product or service references;
  • Validate their order after verification;
  • Confirm the order and payment;
  • Make payment under the provided conditions.

In accordance with the Civil Code provisions on online contracts, the contract is concluded when you click the button confirming your order after viewing the full details and total price and having the opportunity to correct any errors.

Order confirmation implies acceptance of these terms and conditions, acknowledgment of having full knowledge thereof, and waiver of any other terms of purchase.

All data provided and the recorded confirmation serve as proof of the transaction. Confirmation serves as a signature and acceptance of the operations carried out.

The seller will send an order confirmation by email.

Article 9: Right of Withdrawal

Non-professional individual buyers have a period of fourteen (14) days to exercise their legal right of withdrawal from the date of receipt of the products. For service orders, the period starts from acceptance of the offer.

However, under Article L. 221-18 of the French Consumer Code, food products unsealed by the consumer cannot be returned for hygiene or health protection reasons.
Therefore, lecerisier.com cannot under any circumstances take back sold food items.

Article 10: Payment

Payment is due upon ordering.

Accepted cards include CB, Visa, MasterCard, and American Express. Depending on the order date, a debit request will be sent to the buyer’s bank within three (3) days. The order becomes final once the payment center approves it.

Payments are processed via the secure Stripe payment system, which uses SSL (Secure Socket Layer) encryption to ensure transmitted information remains confidential.

It is the buyer’s responsibility to save and print the payment receipt if they wish to keep transaction details.

Upon request, a paper invoice including VAT will be provided.

Article 11: Legal Guarantees

All products supplied by the seller are covered by legal guarantees:

  • Guarantee of conformity (Articles L211-1 et seq. of the French Consumer Code)
  • Guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code)
  • Contractual guarantee

In case of non-conformity, the product may be returned to the seller for replacement or refund.
All complaints or warranty claims must be submitted by mail or email. No product returns are accepted without prior claim registration and return instructions.

Article 12: Liability

The seller’s obligation, in online sales, is one of due diligence. The seller cannot be held liable for damages resulting from Internet use, such as data loss, intrusion, viruses, service interruptions, or other involuntary issues.

Article 13: Intellectual Property

All elements of the lecerisier.com website remain the exclusive intellectual property of lecerisier.com.

No one is authorized to reproduce, exploit, redistribute, or use any part of the site—software, visuals, or audio—for any purpose, even partially.

Any simple or hypertext link is strictly prohibited without the express consent of lecerisier.com.

lecerisier.com never has access to customers’ banking details.

Article 15: Archiving – Proof

Contracts concluded on our website (order data and applicable T&Cs on the order date) are archived for one (1) year. You may request access to archived contracts by email or postal mail.

The computerized records of lecerisier.com are considered a reliable and durable copy under Article 1348 of the Civil Code and will serve as proof of communications, orders, payments, and transactions between the parties.

Article 16: Retention of Title

lecerisier.com retains ownership of goods until full payment of the price, including principal and interest.
In the event of non-payment, lecerisier.com may reclaim the goods, and the sale will be automatically canceled if deemed appropriate.

Article 17: Applicable Law and Jurisdiction

These terms are subject to French law. The language of this contract is French.
In case of dispute, jurisdiction lies with the defendant’s place of residence or, at the claimant’s choice, the place of effective delivery of the product.
